Aboriginal and Torres Strait Islander Social Justice
The title of this session on the conference program is 'The history of human rights in Australian law'. I have chosen to slightly change the topic for a number of reasons. The main reason is because Indigenous peoples' struggle for recognition of their human rights remains to a large extent unfulfilled. Consequently, it is not, and has never been, well reflected in Australian law. Second, because human rights continue to be poorly and rather patchily implemented in our legal system.

About six weeks ago I had a dream in which I was about to give this presentation. As I was walking up to the lectern, I suddenly realised that I had forgotten to include anything about the National Arts and Disability Strategy. Not only had I forgotten to include it in my notes, but I couldn't remember a single thing about it. I started to imagine boos and hisses from the audience, projectile tomatoes, and (the presenter's worst nightmare) loud snores. But then, in the dream, I somehow knew that I could end it all by waking myself up. And that's what I did.

Good afternoon ladies and gentlemen. Welcome to the launch of the report of the national inquiry into the human rights of people with mental illness. This report is the result of extensive research; public hearings in all States and Territories; and oral evidence and written submissions from over 1300 witnesses. I have been extremely fortunate to have the assistance of two commissioners with a long standing interest in the area of mental health - Dame Margaret Guilfoyle and Mr David Hall.

Since the Disability Discrimination Act (DDA) came into force in March 1993 complaints to the Australian Human Rights Commission and State/Territory anti-discrimination agencies have shown that while a building might meet the requirements of building law it could still be the subject of a successful complaint under anti-discrimination law.

Thank you for the chance to speak with you at your AGM today. AGMs are important formal processes in the corporate life of an organisation. But they also provide an opportunity to reflect on what the organisation has achieved over the last twelve months, and to look into the future at the challenges ahead. You - as members, directors, staff and supporters of Epilepsy Action - know the organisation much better than I do. So I'm not going to attempt a review of your past, or polish up my crystal ball for some future gazing.

Australian summer holidays. The phrase evokes an image of sun, sand, slow days and late nights. But just imagine you and your mates are staying on the Gold Coast and it takes 20 phone calls for you to find a beachside unit with a shower you can use. Or the only wheelchair accessible restaurant in a 3km radius is fully booked so you have to eat take-away most nights.

The fact that CEOE is conducting this forum in itself indicates that disability is widely seen by business as presenting significant occupational health and safety (OH&S) issues. And certainly, concerns related to occupational health and safety are widely experienced by people with disabilities as barriers to equal opportunity in employment.

It's great to be here today. I can't think of a better time to be taking stock of developments in human rights law and policy in Australia, or a better place to be doing this than Victoria. As a Sydney-sider I have to admit I haven't always been fully appreciative of the number plates down here, which proclaim: ‘Victoria: The Place to Be!’ But there's no doubt that Victoria is the place to be right now, when it comes to human rights developments.
