We all know that prejudices are prevalent within our society. We also know that such prejudices often translate into discrimination. And yet, proving discrimination is notoriously difficult.[1]

The past year has been one of great contrasts. Under section 46C(1)(a) of the Human Rights and Equal Opportunity Commission Act 1986 (Cth), the Social Justice Commissioner is required annually to submit a report to the Attorney-General on the exercise and enjoyment of human rights by Aboriginal persons and Torres Strait Islanders (the Social Justice Report).

The Aboriginal and Torres Strait Islander Commissioner, Tom Calma, argues in the Native Title Report 2005 that the Australian Government's proposal to encourage individual leases on Indigenous land will not necessarily lead to improved economic outcomes for Indigenous people.
